Possible Constitutional Crisis Revival

Junior Brandon Sherr has filed a suit against the special Joint Elections Committee for not holding another election to ratify the new constitution after the student court nullified what would have been the organizations new governing documents.

In December students voted to ratify a new constitution that would have brought sweeping changes to the structure of the SA and election rules. Junior Jeff Goodman filed a student court case arguing that the election rules governing the constitutional referendum never officially passed out of the senate so the ratified constitution was invalid.

The court ruled in favor of Goodman and the constitution that has been used all year has remained in effect.

Sherr claims in his case against the special JEC, which oversaw the constitutional referendum, that when the court invalided the results from the December election, it automatically requires the sJEC to hold another election.

The court has not yet decided if they will hear the case. If they do accept the case and rule in favor of Sherr, the sJEC may be required to hold another constitutional referendum election within 20 days.

The SA Presidential election is approaching as well. The current constitution requires the entire University to be on campus. Because some graduate students have spring break a week before undergraduates, the election may have to be held after the undergraduate spring break, after March 20th.

The SA has not yet officially passed new election rules to oversee the polling. Nor have members been appointed or nominated to sit on the election oversight body.

The senate will be meeting next week to consider the new election rules. With Sherr’s new case, it appears the constitutional crisis may have new life.
